How Will Arizona’s New Stormwater Permitting Rules Affect Your Company?

The Arizona Department of Environmental Quality (ADEQ) has now released the new Multi-Sector General Permits (MSGPs) for industrial stormwater discharge activities. The MSGPs were signed on December 20, 2010 and will go into effect on February 1, 2011. There will be a 120-day deadline for updating the SWPPP and submitting the Notice of Intent (NOI) ending on May 31, 2011.

Facilities must act quickly to comply or they could face disciplinary actions that disrupt operations and cost money. The MSGPs affect multiple industries, including:

Facilities that were covered by the 2000 MSGP need to file a NOI to be covered by the 2010 MSGP. They must then review and update their Stormwater Pollution Prevention Plan (SWPPP) to ensure compliance with the new regulations.

Facilities that are not covered by the 2000 MSGP need to apply for coverage. They must file an NOI and have a compliant SWPPP in place before discharging stormwater.
